1. The App

Apex is a fitness-training app that can use your device camera to count repetitions and help you view workout progress. It is designed for general fitness and informational purposes only. It is not medical advice, medical care, diagnosis, treatment, or a substitute for advice from a qualified healthcare professional.

2. Eligibility and account

You must be at least 16 years old to use Apex. You are responsible for providing accurate account information, keeping your login credentials confidential, and for activity under your account. Contact us promptly at support@ap3x-fit.com if you suspect unauthorized access.

You may use Sign in with Apple, Google, or email where those options are offered. If you delete your account, your right to use account-based features ends, subject to our Privacy Policy and any subscription you must separately cancel through Apple.

3. Camera and device permissions

Camera permission is optional, but it is required for camera-tracked workouts. Apex processes camera frames locally and in real time to infer exercise movement; it does not record or transmit the video feed. You are responsible for using your device safely, placing it securely, and ensuring that you have permission from anyone who may appear in the camera view.

Apple Health and notifications are optional features. You control these permissions in the App and in iOS Settings.

4. Fitness and safety disclaimer

Exercise involves inherent risks. Consult a qualified healthcare professional before starting a new exercise program, especially if you have a health condition, injury, are pregnant, or have concerns about your ability to exercise safely. Stop immediately and seek medical advice if you feel pain, dizziness, shortness of breath, or other concerning symptoms.

You use Apex and perform exercises at your own risk. The App’s repetition counts, calorie estimates, streaks, and other outputs may be inaccurate and must not be relied on for medical, health, or safety decisions.

5. Subscriptions and purchases

Some Apex features may require a paid purchase or subscription. Prices, included features, trial terms, and the billing period will be displayed in the App before you confirm a purchase.

Purchases are processed by Apple through your Apple ID. If you purchase an auto-renewable subscription, it renews automatically unless you cancel it at least 24 hours before the end of the current billing period. Your Apple ID will be charged within 24 hours before renewal. You can manage or cancel subscriptions in your Apple ID account settings. Except where required by applicable law, payments and refunds are handled by Apple under Apple’s policies.

We may change future subscription prices or features with prior notice where required. Changes do not affect an already-paid current billing period.

6. Acceptable use

You may use Apex only for lawful, personal, non-commercial purposes. You must not:

• copy, modify, reverse engineer, decompile, or attempt to extract the App’s source code except where applicable law permits it;

• interfere with the App, its security, accounts, subscriptions, or other users;

• use the App to violate law or another person’s rights;

• submit deceptive information or manipulate workout, challenge, or purchase features; or

• use the App in a manner that could harm people, devices, or our services.

7. Challenges and shared content

If Apex offers challenges, invitations, results sharing, or other social features, you are responsible for the information you share and for ensuring it is lawful and appropriate. Do not share another person’s personal information without permission. We may remove content or restrict participation to protect users or the App.

8. Intellectual property

The App, its software, design, text, graphics, trademarks, and other content are owned by or licensed to us and protected by law. Subject to these Terms, we grant you a limited, personal, revocable, non-transferable, non-sublicensable license to use the App on Apple-branded devices that you own or control.

9. Availability and changes

We may update, suspend, or discontinue any part of Apex, including a feature or subscription offering, where reasonably necessary. We do not guarantee that the App will always be available, error-free, or compatible with every device. We may suspend or terminate access if you materially breach these Terms or if needed to protect the App, users, or legal rights.

10. Disclaimers and liability

To the maximum extent permitted by law, Apex is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We do not warrant that workout outputs will be accurate or that the App will meet every need.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from use of the App. Nothing in these Terms excludes liability that cannot legally be excluded, including liability for intentional misconduct or for death or personal injury caused by negligence where applicable law prohibits exclusion.

11. Apple-specific terms

These Terms are between you and us, not Apple. Apple is not responsible for the App, its content, maintenance, support, warranties, claims, or defense of claims relating to the App. If the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, as required by its policies; to the maximum extent permitted by law, Apple has no further warranty obligation regarding the App.

You must comply with the App Store Terms of Service when using Apex. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Governing law and disputes

These Terms are governed by the laws of the Czech Republic, excluding its conflict-of-law rules, except where mandatory consumer-protection law in your country of residence provides greater protection. Courts with jurisdiction under applicable law will resolve disputes.

13. Changes to these Terms

We may update these Terms when the App, subscriptions, or law changes. We will post the new Terms in the App and update the effective date. If a change is material, we will give additional notice where required by law. Continuing to use Apex after the new Terms take effect means you accept them.
